TERMS & CONDITIONS (ALLGEMEINE GESCHÄFTSBEDINGUNGEN)

1. VALIDITY OF THE TERMS AND CONDITIONS

House of Gefion by Julie Marie Kjersem (hereinafter referred to as "House of Gefion") provides all supplies and services in connection with the online store on the basis of the following Terms and Conditions. This version of the Terms & Conditions is valid at the time of the order.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions, including those additional Terms and Conditions and Policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are customers, merchants, browsers, vendors, and/ or contributors of content.

Purchase contracts regarding used and exhibition goods are also part of these Terms and Conditions, but excluding all claims of the buyer regarding the following provisions: 1) Delivery costs, where separate provisions will apply, 2) The warranty on the product is void.   

Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website.

Our store, www.houseofgefion.com is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.


2. OFFER AND CONTRACT

The presentation of the products in the online shop does not constitute a legally binding offer, but a request for an offer.

By clicking on the "Order" button, the customer makes a binding order for the products listed on the order page.

Immediately upon receipt of the order, House of Gefion confirms the receipt of the order by e-mail. The purchase contract is only concluded when House of Gefion delivers the goods.

House of Gefion is not obliged to accept orders if the customer has any overdue outstanding payments from previous purchases or if his/her account is subject to legal action. If customer's payment disputes are determined only after conclusion of the purchase contract, House of Gefion has the right to withdraw from the contract at any time and without any compensation. Furthermore, House of Gefion reserves the right to refuse service to anyone for any reason at any time.


3. PRICES & SALE

The prices are indicated in CHF, including Swiss VAT. Promotional prices and special discounts are specifically and separately shown. Transport and packaging costs are not included in the price, unless otherwise listed.

House of Gefion reserves the right to adjust prices on an ongoing basis. Customers are subject to the prices confirmed at the time of order. The indicated selling prices in CHF take into account, as far as possible, the current exchange rate development.

In House of Gefion we seek to follow the recommended retail prices and match the prices to the EUR currencies. Should you happen to find a product at a more affordable price somewhere else in Switzerland, please share it, and we will do our best to match it (i.e. not including special offers or campaigns etc.).


4. RETURN & EXCHANGES

Items can be returned within 14 days with the original receipt. The items must be unused and returned in the original packaging.

Custom ordered products and products that are not on stock (i.e. ordered especially for the customer) are not eligible for returns or changes. The cost for the returns falls upon the customer to pay. 

When House of Gefion receives the returned items, it will be checked that it is in the original packaging, unharmed and in an unused condition. Furthermore the original receipt or bill needs to be included. When this is the case, you will receive a refund of your money with the payment method, which you choose (i.e. Visa, Mastercard, PayPal etc.). This can take a few days.   

Should the product have been damaged or if it is not complete, please contact House of Gefion immediately.  

Returns of gifts
Are you returning a gift, which has been purchased in House of Gefion, then you will receive a gift certificate to House of Gefion for the price of the product you received. Gift certificates cannot in general be returned or exchanged for money. 


5. DEFECTIVE GOODS

Defective goods can be returned directly to the manufacturer within the statutory or product warranty period. The address is available via hej@houseofgefion.com


6. DELIVERY AND COLLECTION CONDITIONS, TRANSFER OF BENEFITS AND RISKS

The delivery data of purchased items is given without obligation, and the delivery date may change. Delivery delays do not entitle to rescission of the purchase contract or to claims for damages of any kind.

The estimated delivery time is communicated at the time of the purchase and listed in the order confirmation. It usually depends on the delivery time of the respective supplier.

Should a product no longer be available, House of Gefion can withdraw from the contract wholly without compensation. Already paid payments will be refunded.

If an advance payment or prepayment has been agreed with the customer, the delivery will be made only after full payment. House of Gefion assumes no liability for any delays in delivery due to non-payment of account.

House of Gefion will decide on the ultimate mode of transport (mailing or delivery by a furniture carrier). If the purchase contract includes several items, delivery or shipping will be executed as soon as all the goods are collected and ready for delivery. 

Orders, which have been specified for Pickup in the store, are to be picked up within 7 working days. Thereafter the order will be automatically deleted

For deliveries to peripheral / mountainous regions (such as Wengen & Zermatt), as well as car-free zones or homes where a lift is needed to delivery the furniture the effective costs will be charged additionally.

In terms of very big and bulky items such as sofas, tables etc. then please do check in advance if delivery to your apartment, with two men, is possible at all. Should the staircase or the lift etc. be too narrow, the additional cost of the furniture delivery will be charged in this case.

In the case of delivery to addresses abroad (i.e. outside of Switzerland), House of Gefion decides whether a delivery abroad is possible and which points of the Terms & Conditions (for example, delivery costs, payment terms, guarantee etc.) will change.

The transfer of benefits and risks of new goods takes place once the customer has received the purchased goods. I.e. after handover for delivery or shipping. In the case of used and exhibition goods, the benefits and risks are transferred to the customer as soon as the contract is concluded. 

House of Gefion only acts as an intermediary and assumes no liability for any damage of delivery and assembly of the goods by the delivery company. 

House of Gefion is responsible for ensuring that the packaging is suitable for normal transport conditions, but declines any liability for transport damage caused by improper handling by third parties after goods have been dispatched. Before signing the delivery note, be sure to check the packaging of the delivered furniture for any transport damage. Contact House of Gefion immediately if the goods were delivered incomplete or defective. Write the addition on the delivery note; "Goods accepted with reservation" and send a photo of the defective goods or the battered packaging to hej@houseofgefion.com. This makes it easier for us to apply for damages.

7. TERMS OF PAYMENT

Payment is made on account, credit card or PayPal. If goods are delivered with an invoice, the payment is due within 14 days. If the payment is not made on time, the customer is in default without a reminder and owes House of Gefion a default interest of 5%.

Until full payment, the goods remain the property of House of Gefion.

House of Gefion may grant vouchers (for example, welcome vouchers) or gift cards (purchased voucher cards). Vouchers and gift cards can only be used for future purchases in the online store. They cannot be counted on shipping costs. The redemption of a voucher or a gift card can be tied to a minimum order value. House of Gefion reserves the right to accept only one voucher or gift card per order, as well as not allow the accumulation of voucher and gift card. The voucher or gift card cannot be exchanged for money or paid out. Unless the period of validity is expressly stated (for example, for a specific period or a sales promotion), a coupon or gift card expires one year after the issue.


8. LIABILITY AND WARRANTY

The buyer must check the delivered goods as soon as possible. Complaints must be made within 7 days after receipt of the goods. Defects appearing later during the warranty period must be reported immediately to the manufacturer of the product.

Deviations in structure and color cannot be avoided with certain materials (wood, marble, leather, textiles, etc.) compared to the specifications and therefore do not entitle you to complaints or warranty claims. Normally no guarantee can be given for the lightning of the colors in wood, leather, plastic and certain textile fabrics over time.

Excluded from the guarantee are damages caused by incorrect operation or caused by wear, aging and improper handling. The guarantee expires if the goods were processed or changed by the purchaser despite recognizable defects.

House of Gefion rejects any liability for damage caused by the use of the goods on the building fabric (for example floor, walls) or on the furniture of the purchaser. The purchaser must ensure that the product does not cause any damage before use.

If defects justified by the purchaser are asserted in writing in the sense of these provisions, House of Gefion has the choice to repair the defects or to replace the defective goods or parts thereof with new ones. The duration of the warranty is not renewed or extended by the possible repair or replacement. Further claims of the purchaser, including lost profit, consequential damage or other financial losses are expressly excluded within the scope of the statutory permissible


9. PRIVACY POLICY

Your submission of personal information through the store is governed by our Privacy Policy.


10. APPLICATION OF LAW AND JURISDICTION

These terms and conditions are governed by Swiss law. Jurisdiction is Zurich.


11. ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We shall not be held liable to this and reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).


12. CHANGES TO TERMS AND CONDITIONS

You can review the most current version of the Terms and Conditions at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditons by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
